DAS TÉCNICAS EXECUTIVAS PARA GARANTIA DO CRÉDITO NA EXECUÇÃO DE OBRIGAÇÃO DE PRESTAR ALIMENTOS

Resumo
Neste artigo busca-se realizar, como objetivo geral, um estudo sobre as medidas judiciais cabíveis, na forma das técnicas executivas, para assegurar a garantia do crédito e, por consequência, satisfação da obrigação, no cumprimento de sentença que reconheça a exigibilidade do dever de prestar alimentos. O estudo decorre do recente entendimento do Superior Tribunal de Justiça sobre a possibilidade de cumulação das técnicas executivas (expropriação de bens e prisão do devedor) no procedimento para execução de dívida alimentar. Para tanto, inicialmente, será realizada uma breve análise do procedimento da ação de alimentos e suas fases, em especial, a fase executiva. Na sequência serão abordadas as técnicas executivas para a garantia e satisfação da obrigação alimentar de forma provisória e definitiva. Ao final, seguirá o estudo com uma análise sobre como, de modo geral, os Tribunais Estaduais têm se pronunciado sobre o tema, após a decisão da Corte Superior Para elaboração deste artigo, utiliza-se do método de abordagem Indutivo, através de pesquisas bibliográficas e jurisprudenciais. Convém mencionar que as pesquisas acerca dos referidos temas foram levantadas do acervo da Biblioteca online do Centro Universitário para o Desenvolvimento do Alto Vale do Itajaí.

Abstract
This article seeks to carry out, as a general objective, a study on the appropriate judicial measures, in the form of executive techniques, to ensure the guarantee of the credit and, consequently, satisfaction of the obligation, in the fulfillment of a sentence that recognizes the enforceability of the duty to provide alimony. The study stems from the recent understanding of the Superior Court of Justice on the possibility of cumulating executive techniques (expropriation of assets and imprisonment of the debtor) in the procedure for executing a maintenance debt. To do so, initially, a brief analysis of the maintenance procedure and its phases will be carried out, in particular, the executive phase. In the sequence, the executive techniques for the guarantee and satisfaction of the maintenance obligation in a provisional and definitive way will be approached. At the end, the study will follow with an analysis of how, in general, the State Courts have ruled on the subject, after the decision of the Superior Court, when it is necessary to face the matter, in particular, the Courts of Justice of the States from Minas Gerais and São Paulo. For the preparation of this article, the Inductive method of approach is used, through bibliographical and jurisprudential research. It should be mentioned that the research on the aforementioned topics was taken from the online library collection of the University Center for the Development of Alto Vale do Itajaí.
