COERÊNCIA INTERPRETATIVA E JUIZADOS ESPECIAIS

Resumo
O presente artigo expõe a partir do constitucionalismo e da teoria da Constituição a necessidade de limitação e controle dos poderes, não só políticos, sociais ou econômicos, mas, especialmente, dos juízes. Neste cenário, é fundamental estabelecer parâmetros constitucionais válidos à interpretação constitucional, de modo que a interpretação/decisão não se converta e se fundamente em opções pessoais. A reflexão proposta considera, particularmente, o sistema que compreende os Juizados Especiais, no qual o julgador goza de amplos poderes na condução do processo, conforme institui a Lei 9.099/1995. Este é o dilema: tal margem de discricionariedade judicial é constitucionalmente válida?

Abstract
This paper presents from the theory of constitutionalism and constitution of the need for control and limitation of powers, not only political, social or economic, but especially the judges. In this scenario, it is essential to establish constitutional parameters to the valid constitutional interpretation, so that the interpretation /decision will not become and is based on personal choice. The discussion considers the proposal, particularly, the system comprising the Special Courts, in which the judge enjoys wide discretion in conducting the proceedings, as establishing the Law 9.099/1995. This is the dilemma: that judicial discretion is constitutionally valid?
