A CULTURA DA DESOBEDIÊNCIA: uma abordagem doutrinária sobre a ausência de sujeição dos cidadãos às vontades Estatais

Resumo
Este artigo tem por objetivo o estudo de alguns aspectos da cultura da desobediência. Trata-se de uma abordagem com levantamento de dados através da técnica da pesquisa bibliográfica e, portanto, doutrinária, procedida pelo método indutivo. Dá-se início às investigações com a conceituação semântica da desobediência. A seguir, são apuradas questões como: quais são os direitos tutelados pelas normas estabelecidas pelo Estado e a natureza de tais direitos, teorias filosóficas sobre o Contrato Social e hipóteses previstas por Thomas Hobbes, John Locke e Jean-Jacques Rousseau para explicar as motivações da renúncia das liberdades em nome de uma ordem política e para justificar o descumprimento deste contrato. Tem-se, por fim, o estudo do que se entende por uma “cultura” de desobediência às normas e algumas causas subjetivas desta desobediência.

Abstract
This essay has a purpose to study the dimension of the culture of disobedience. The doctrinal approach through analysis of the bibliography was conducted by an inductive method. The beginning of the investigation is a study of the disobedience's semantic concepts. Afterward questions about what are the rights are warded by State's rules, like their source; the philosophic theories about Social Contract by Thomas Hobbes', John Locke's and Jean-Jacques Rousseau's understanding to explain how the liberty is conceded in the name of a political order and how it justify its break. At last, it is an understanding about the culture of disobedience as result of the breaking rules and some subjective aspects that disobedience.
