RESTOS DE AMOR JOGADOS NO TRIBUNAL: Medição judicial e psicologia como ferramentas para a busca da reconciliação

Resumo
O presente trabalho justifica-se com o objetivo de evidenciar a importância de promover a aproximação das ciências – Psicologia e Direito – para que possam trabalhar juntas em prol do bem-estar de casais em processo de divórcio. Paralelamente, visa destacar o processo de Mediação Judicial - forma alternativa e não adversarial de solução de conflitos - como ferramenta para a busca da reconciliação do casal, no qual o ponto de vista psicológico desta questão, sob decisão judicial, tenha espaço efetivamente. O casamento como centro da felicidade humana torna-se incompatível com as características da vida contemporânea. Todavia, a literatura mostra que o amor continua sendo a primeira razão pela qual os sujeitos se unem em laço conjugal. Frente a isso, observa-se quão destrutivas podem ser as idealizações quando a relação amorosa chega ao fim. Considerando a complexidade que envolve o rompimento conjugal, os resultados da pesquisa ressaltam a importância da Mediação nos processos de divórcio, para que os finais das histórias de amor tenham mais ‘felizes para sempre’ ou apenas ‘felizes’. O método de investigação as técnicas foram as de pesquisa bibliográfica e fichamento.

Abstract
This work is justified in order to highlight the importance of promoting the rapprochement of sciences - psychology and law - so they can work together for the sake of the welfare of couples in divorce proceedings. At the same time, aims to highlight the process of Judicial Mediation - Alternative and non-adversarial form of conflict resolution - as a tool for the pursuit of reconciliation of the couple, in which the psychological point of view this question, under court order, has space effectively. Marriage as the center of human happiness becomes incompatible with the characteristics of contemporary life. However, the literature shows that love remains the first reason why the subjects are united in marriage bond. Faced with this, we observe how the idealizations can be destructive when the love affair comes to an end. Considering the complexity involving marital breakup, the survey results underscore the importance of mediation in divorce proceedings, so that end of love stories have more 'happily ever after' or just 'happy'. The research method used was the inductive and techniques were the bibliographic research and book report.
