CONCEPÇÃO CONTEMPORÂNEA DA JURISDIÇÃO BRASILEIRA

Resumo
O presente estudo pretende abordar as definições de jurisdição a partir dos troncos doutrinários de Chiovenda e Carnelutti até sua atual concepção, dada a relevância da evolução deste conceito para o entendimento do acesso formal ao Judiciário e prestação de uma adequada tutela jurisdicional aos cidadãos, notadamente após a redemocratização do país. O objetivo deste artigo é analisar os conceitos que se desenvolveram no último século e sua renovação até a contemporaneidade, passando pela interpretação legislativa dos princípios e garantias constitucionais nas decisões judiciais, bem como o ativismo judicial presente hoje no Estado brasileiro, a fim de que se possa construir uma breve concepção contemporânea da jurisdição brasileira. O método utilizado na fase de investigação foi o indutivo; na fase de tratamento dos dados foi o cartesiano, e o presente relatório é composto na base lógica indutiva.

Abstract
The present study pretends to aboard the definition of jurisdiction starting from the doctrinal trunks of Chiovenda and Carnelutti until its current design, given the relevance of the evolution of this concept for understanding the formal access to the Judiciary and the provision of an adequate legal protection to the citizens, notedly after the country democratization. The objective of this work is to analyze the concepts that have developed in the last century and its renewal until the contemporaneity, passing through the legislative interpretation of the principles and constitutional guarantees in judicial decisions, as well as judicial activism present in today in Brazil, in order to build a brief contemporary conception of brazilian jurisdiction. The method used in the research phase was the inductive, in the processing phase was the cartesian, and this report is composed in inductive logic base.
