A PENA PRIVATIVA DE LIBERDADE COMO INSTRUMENTO DO CONTROLE PENAL SOCIAL: Mito ou realidade?

Resumo
O presente artigo tem como objeto de pesquisa a fomentar a reflexão acerca da pena privativa de liberdade, do seu aspecto seletivo e do seu papel preventivo como suposto instrumento de controle penal social de forma a garantir o controle de poder. Parte-se do pressuposto de que muito embora a pena esteja em nosso sistema guardada pela Constituição Federal e lei ordinária, tal fato não é sinônimo nem garantia de concretização daquilo que se entende por equânime, tampouco da legitimação do direito, pois já não se sustenta um direito penal exclusivo e com propósito único de manter a pena privativa de liberdade como instrumento de eliminação do indivíduo marginalizado do convívio social. Para a composição deste artigo, foi utilizado o Método Indutivo tanto na fase de investigação quanto na apresentação do relato dos seus resultados e, conjuntamente, foram adotadas as Técnicas do Referente, da Categoria, do Conceito Operacional e da Pesquisa Bibliográfica.

Abstract
This article is the subject of research to promote reflection on the deprivation of liberty, its selective aspect and its preventive role as the alleged criminal social control instrument to ensure the control of power. This is on the assumption that although the penalty is saved in our system by the Federal Constitution and ordinary law, that fact is not synonymous nor guarantee achievement of what is meant by equal, nor the legitimacy of the law because no longer sustains an exclusive criminal law and for the sole purpose of maintaining the deprivation of liberty as a disposal instrument marginalized individuals from society. For the composition of this article, we used the Inductive Method both in the research phase and in the presentation of the report of its results and, together, the techniques were adopted from Referent, Category, Operational Concept and bibliographical research.
