VERDADE E SIGNIFICADO NA MATRIZ DISCIPLINAR PROCESSUAL: homenagem ao Professor Ovídio Araújo Baptista da Silva (in memorian)

Resumo
O presente artigo propõe examinar o pensamento de Ovídio Araújo Baptista da Silva em “Verdade e Significado”, objeto de publicação em Portugal (2006) e no Brasil (2005), de onde se extrai o tema, cuja presença resta garantida na matriz disciplinar do sistema processual. Para tanto, elege-se o escopo geral no sentido de examinar “verdade e significado” a partir do “direito que é” e do “direito que deve ser”, cuja referência diz respeito à separação entre direito e fato, inspirada na premissa kantiana do ser e do dever ser, revelador dos compromissos da ciência processual com a sua própria história e a ordem jurídica presente no ordenamento pátrio que deve assistir e ser partícipe do progresso técnico-científico, de uma tal função com a verdade e sua condição com a paz judiciária. A conclusão pretende expor e argumentar a “verdade” e seu significado no paradigma processual, cujo sentido polissêmico, segundo a fórmula ovidiana, é tradutora de uma matriz crítica, relativamente aos fundamentos do sistema. Em relação a metodologia, a técnica de pesquisa utilizada é a bibliográfica e o método de abordagem é o dedutivo.

Abstract
The present article proposes to examine the thought of Ovídio Araújo Baptista da Silva in “Verdade e Significado”, object of publication in Portugal (2006) and in Brazil (2005), from which the theme is extracted, whose presence remains guaranteed in the matrix disciplinary system. To do so, the general scope is chosen in the sense of examining "truth and meaning" from the "law that is" and the "law that must be", whose reference concerns the separation between law and fact, inspired by the Kantian premise of being and of being, revealing the commitments of procedural science with its own history and the legal order present in the national order that must assist and be a participant in the technical-scientific progress, of such a function with the truth and its condition with the judicial peace The conclusion intends to expose and argue the “truth” and its meaning in the procedural paradigm, whose polysemic meaning, according to the Ovidian formula, translates a critical matrix, regarding the foundations of the system. Regarding methodology, the research technique used is bibliographic and the approach method is deductive.
