A ORIGEM DO ESTADO: UMA REFLEXÃO ACERCA DAS TEORIAS NATURAIS E CONTRATUAIS

Resumo

O presente artigo tem por propósito investigar as origens da formação do Estado. Para tanto, é inaugurado por meio de algumas considerações gerais acerca do Estado, para então avançar sobre as duas principais teorias que elaboraram respostas sobre a questão da origem do Estado, quais sejam, as teorias naturais e as teorias contratuais. De um lado há as vertentes naturalistas que defendem o surgimento do Estado por meio de um processo natural de associação entre os seres humanos. Essas vertentes possuem como principais representantes Aristóteles, Cícero e, contemporaneamente, Ranelletti. Por sua vez, as teorias contratuais propõem que em um determinado momento, por meio de um acordo, ou contrato, motivado por razões e desejos específicos, os homens reuniram-se e decidiram conviver em grupos, o que proporcionou o surgimento do Estado. Os principais representantes da teoria contratual são Hobbes, Locke e Rousseau. Essas duas teorias e o pensamento de seus principais representantes são expostos e contrapostos com o intuito de se extrair uma visão conjunta de todas as questões que envolvem a investigação sobre a origem do Estado.

Abstract

This work has the purpose to investigate the origins of the state formation. Therefore, the work starts by some general considerations about the state, and then proceed on the two main theories that have developed answers about the questions of state origin, the natural theories and contractual theories. On the one hand, the naturalistic side argues that the state arose through a natural process of association between humans. This side has as main representatives Aristotle, Cicero and, contemporaneously, Ranelletti. In other turn, contractual theories propose that at any given time, through an agreement, or contract, motivated by reasons and desires, the men met and decided to live together in groups, which provided the emergence of the state. The main representatives of the contractual theory are Hobbes, Locke and Rousseau. These two theories and the thinking of its main representatives are exposed and opposed in order to extract a joint vision of all the issues surrounding the investigation of the state of origin.
