Resumo
Este artigo objetiva demonstrar, analisar e descrever os aspectos históricos e fundamentos das correntes do direito natural e do direito positivo. Nesse sentido buscar-se-á explanar os fatores históricos, influências e principais precursores de cada teoria, bem como analisar brevemente os fundamentos de tais correntes do pensamento jurídico sob o prisma da Filosofia do Direito. O estudo tem como finalidade ainda o entendimento acerca das ideias que se traduziram numa verdadeira concepção dualista do direito: de um lado o direito positivo, editado pelo Estado; do outro estava o direito natural, absoluto e imutável. Por fim, com este estudo demonstrar-se-á a importância da consideração dessas teorias para a melhor compreensão do ordenamento jurídico em vigor.

Abstract
This article aims to demonstrate, analyze and describe the historical and current foundations of natural law and positive law. Accordingly seek will explain the historical factors, influences and main precursors of each theory, and briefly examine the foundations of such currents of legal thought in the light of the philosophy of law. The study aims to further the understanding of the ideas that led to a real dualistic conception of law: on the one hand the positive law, issued by the state, the other was a natural right, absolute and immutable. Finally, this study will demonstrate the importance of considering these theories to better understand the legal system in force.
