Resumo
Principia–se com a abordagem histórica realizada, o levantamento das peculiaridades de um direito de natureza fundamental e seu “espaço” no Estado Democrático de Direito. Em seguida, sua titularidade e eficácia, com a finalidade de definir claramente o que é esse instituto e quais benefícios elementares podem ser classificados como tal. Referidos direitos possuem (a princípio) quatro dimensões, sendo a primeira dimensão a passagem de um estado autoritário para um estado de Direito, onde se passou a respeitar as liberdades individuais. E, na quarta dimensão verificam-se os direitos à democracia, informação e ao pluralismo. No que tange aos direitos fundamentais na Constituição de 1988, os mesmos aparecem catalogados e foram resultado de um amplo processo de discussão oportunizado com a redemocratização do País após mais de vinte anos de ditadura militar. Acerca das características dos direitos fundamentais, foi abordada a historicidade, a universalidade, a inalienabilidade, a imprescritibilidade, a irrenunciabilidade e a indivisibilidade. Por fim, destacou-se a titularidade da norma de direito fundamental, pois embora universal, há ressalvas. E, para arrematar sua aplicabilidade no universo jurídico e abordagem nos tratados internacionais.

Abstract
Begins with the historical approach carried out a survey of the peculiarities of a right of a fundamental nature and your "space" in a democratic state. Then, their ownership and effectiveness, in order to clearly define what this institute and what basic benefits can be classified as such. Those rights have (at first) four dimensions, the first dimension being the passage of an authoritarian state to a rule of law, which came to respect individual freedoms. And in the fourth dimension check up the rights to democracy, information and pluralism. With regard to fundamental rights in the Constitution of 1988, they appear cataloged and were the result of an extensive process of oportunizado discussion with the democratization of the country after more than twenty years of military dictatorship. About the characteristics of fundamental rights, addressed the historicity, the universality, inalienability, nonapplicability, the non-waiver and indivisibility. Finally, the highlight was the title of the standard of fundamental right, because although universal, there are caveats. And to finish off their applicability in the legal universe and approach in international treaties.
